Mihnati.com (the "Website") is owned and operated by Gulf TradaNet B.S.C. (GTN). For the purposes of the Terms, "we", "our" and "us" refers to Gulf TradaNet B.S.C. (GTN). The term "Content" used in these Terms includes all information, data, images, graphics and logos available on the Website and the layout and 'look and feel' of the Website under the web address http://www.mihnati.com.

Please review these Terms carefully before using the Website. You agree we may deem your use of the Website as agreement to be bound by the Terms.

CVs and Job Advertisements

CVs and Job Advertisements contained on the site are provided by both Job Seekers and Employers respectively and their agents and are not reviewed by us. We accept no responsibility or liability for the contents of CVs or advertisements and expect candidates and prospective employers to carry out such verification procedures as are customary and prudent in the circumstances.

Job seekers

Use of the Site.

You agree that you will use this Website in accordance with the Terms, and in any event, for lawful purposes only.

In particular, but without limitation, you agree that you will not and will not attempt to:

• Make use or take any action on the software, device or routine (including but not limited to uploading or making available files containing corrupt data, viruses, virus, Trojan horse or worms) to damage, crash, delay, or otherwise interfere with the operation of this Website;
• Spoil, deface, alter or interfere with the 'look and feel' of this Website or the underlying software code, or (except as is expressly required by applicable law) decipher, disassemble or modify any of the software, coding or information comprised in the Website;
• Overload (such as by spamming or flooding) the Website or its related infrastructure;
• Obtain unauthorized access, via whatever means, to any of our networks or information; or
• Collect, aggregate, copy or duplicate in any manner any of the Content without our prior written consent.

Without prejudice to any other rights or remedies to which we may be entitled we reserve the right to:

• remove any information supplied by you from the Website; and
• deny you access to the Website in our sole discretion, at any time and for any reason, without being required to give any explanation.

Services and information provided on the site by us and our third party suppliers are intended to assist in the job seeking or recruitment process. Neither we nor our third party suppliers can guarantee their suitability or prospects of success in any particular case. You should obtain independent verification before relying on information provided on the site in circumstances which may result in loss or damage. We are continually seeking to improve the Services. We reserve the right, in our sole discretion, to make changes to any part of the Services. We make no guarantee of availability of the Website.

You may be offered links to other websites on our Website. We cannot be responsible for the privacy policies and practices of other websites however and do not accept any liability in respect of the content of those websites. Your access and use of such websites is solely at your own risk. You may only link to our Website with our prior written consent, which we reserve the right to withdraw at any time.

Subscription Fees / Other Fees

Job Seekers or individuals seeking work ("Job Seekers"), use of the Website is provided free of charge for Registration. CV Uploading, Building CVs, Applying to Jobs …etc. New services might be provided to Job Seekers which might require certain subscription fees and will be optional for Job Seekers to join or not. At no point will we ask for payment from you, nor seek any credit card or other payment-related details. If such a request is made to you, please decline and let us know immediately by contacting us on support@mihnati.com

Registration

You confirm that you have provided us with accurate and complete registration information that is not false or misleading and which does not contain any unlawful material or content. It is your responsibility to update us with any changes to that information by logging into the system and making the necessary changes through 'My CV' in the Job Seeker Home.

Each registration is for a single user only. On registration, you will be allocated a User Name and Password ("ACCOUNT"). You are responsible for all use of the Services using your Account and for preventing unauthorized use of your Account.

If you believe there has been any breach of security such as the disclosure, theft or unauthorized use of your ACCOUNT, you must notify us immediately by contacting us on support@mihnati.com.

If we reasonably believe that your ACCOUNT is being used in any way which is not permitted by the Terms, we reserve the right to suspend access rights immediately on giving notice to you and to block access from your ACCOUNT until the issue has been resolved.

Intellectual Property Rights

You agree that all trade marks and copyright, database rights, design rights and other intellectual property rights in the Content together with the underlying software code are owned by us and/or our licensors (as the case may be) and in any event are subject to any restrictions or prohibitions imposed by us or the owner(s) of such information (whether directly or indirectly). You also agree that any information in a non-public area of the Website (including without limitation that intended for use only by authorized user(s), and/or requiring some form of password or other code) is strictly confidential.

Liability

You acknowledge and understand that we provide online recruitment services and the website acts as a gateway for Job Seekers and Employers to review opportunities and information about Jobs in all sectors and we do not seek to or have any control (beyond the limited editorial rights pursuant to the Terms) over submissions or their accuracy, quality or truthfulness, and nor do we have any involvement in the negotiation or conclusion of any contract of employment arising from any information submitted to the Website. Accordingly, but subject at all times to the last sentence of this clause, we accept no liability for any loss (whether direct or indirect, for loss of business, revenue or profits, wasted expenditure, corruption or destruction of data or for any other indirect or consequential loss whatsoever) arising from your use of the Website and we hereby exclude any such liability, howsoever arising, whether in contract, tort (including for negligence) or otherwise. Except for the express provisions of the Terms we exclude all warranties, terms and other conditions, including but not limited to any warranty, term or other condition of merchantability, satisfactory quality, fitness for a particular purpose or non-infringement in every case whether implied by statute, common law, custom, collaterally or otherwise. Nothing in the Terms limits liability for death or personal injury caused by negligence, or fraud.

Indemnity

You shall indemnify and hold harmless us and our officers, employees, directors, shareholders, representatives, successors and assignees against any and all costs, expenses (including reasonable legal expenses), claims, losses, liabilities or proceedings arising from the use or misuse by you of this Website. You agree to notify us together with all relevant facts if anyone makes or threatens to make any claim against you relating to your use of this site.

Browser and operating system policy

Mihnati.com endeavors to support as many users as possible, but it has become necessary to cease supporting or actively block some browser versions

Mihnati.com also requires jobseekers to enable session cookies (enabling permanent cookies is recommended), and JavaScript, in their browser. For more information see our Privacy Policy.

Governing law

These terms and conditions shall be interpreted in accordance with GCC law and all disputes shall be decided by the GCC courts.

Employers

General

In these terms and conditions:

• References to 'we', 'us' or 'our' are references to Gulf TradaNet B.S.C. (GTN) / Mihnati.com.
• Advertiser' means any person, company, organization or firm which purchases Services from us;
• 'Services' means all recruitment products and services made available by us from time to time;

Prices

Prices are guaranteed for the period stated on the Invoice. Prices are fixed and subject to known discount for longer subscriptions and are published to all Employers / Advertisers . A job posted on Mihnati.com will remain live for 28 days or such shorter time as we agree with the Advertiser. Any extension of this time will be charged to the Advertiser as a new posting. Any jobs posted in addition to the agreed number of jobs per 28 day period will be charged at a price per job agreed with the Advertiser at the time of the contract negotiation. If no price has been negotiated, the fee stated on the Subscription Application Form (as may be amended from time to time) will be charged for each job over the agreed number. Prices of CV Search Packages are also fixed to all Employers who wish to search the Job Seekers CVs Database.

Termination

The Advertiser may not terminate the provision of Services under any Purchase Order. Termination of subscriptions maybe negotiated at our discretion and can result in loss of discounts or other paid amounts.

We may terminate the provision of Services if:

• the Employer / Advertiser is in material breach of these terms and conditions and has not remedied such breach within 48 hours of notice specifying the breach and requiring that it be remedied, or:
• the Employer / Advertiser becomes insolvent, ceases to trade or goes into liquidation.

Third Party Sites

Job Advertisements you post on mihnati.com may also appear on third party recruitment web sites pursuant to agreements from time to time between mihnati.com and the proprietors of such web sites.

Use of Job Seekers CVs Database

Employers, Employment agencies and Employment Businesses

If you are any type of employer, employment agency or an employment business. It is your responsibility to ensure that the use you make of information from our job seekers database is for the sole purpose of direct use to your own organization. These regulations are currently contained in the Conduct of Employment Agencies and Employment Businesses Regulations 2003. You agree to comply with the Act and any other applicable laws and regulations as they affect the conduct of your business and the use you make of information on our job seekers database.

You may NOT:

• Supply, sell or license material from job seekers database, or a copy of it, to any other person, including another member of your group of companies.
• Contact the individuals on the database or make or allow any use of the information about those individuals, other than for the purpose of finding suitable candidate for specific job vacancies. You must, at all times, comply with the Data Protection Act 1998 and all subsequent legislation and regulations.

Dealings with Job Seekers

You agree to deal fairly and professionally with Job Seekers you may contact using information from the job seekers database and not do anything which may bring mihnati.com into disrepute. You will indemnify mihnati.com from and against any claim brought by an individual against mihnati.com arising from your breach of this obligation or these terms and conditions.

Online Advertising

1. The Services shall commence on the "Subscription Application Form" which shall be defined as the date that both parties agree that the content on the site is satisfactory.
2. The fee shall be payable upon presentation of an invoice by mihnati.com before the activation of the service. In principle, all payments are in advance.
3. The Services shall comprise access to the purchased service, as requested, the Employer/Advertiser shall provide any information or copy promptly. The Employer/Advertiser shall use reasonable endeavors to ensure the truth and accuracy of information supplied by the Advertiser. The Employer/Advertiser understands that to the extent that any additional Services are offered to it, mihnati.com may charge for them additionally.
4. Mihnati.com may issue a unique password to the Advertiser. This password shall not be transferred or misused under any circumstances. If for any reason, a third party has gained unauthorized access to your account, please contact support@mihnati.com immediately.
5. Both parties shall observe obligations under the Data Protection Act 1998 and any other privacy laws. Where the job seeker sends information through to the Advertiser, the information should only be used for the express purpose in which is was sent.
6. Mihnati.com cannot guarantee the accuracy of any information which the Advertiser obtains or is sent through its use of the Website. Mihnati.com cannot accept any liability for any:
   • loss arising from information inputted, received, available at, linked to or removed from the Website howsoever occurring
   • special, indirect or consequential loss, including, without limitation, loss of information, profit, contract, anticipated savings or opportunity;
   • interruption to the Services or access to the Website as a result of events beyond our reasonable control.
7. Nothing in paragraph 6 shall serve to limit mihnati.com's liability for fraud or personal injury or death arising from our negligence.
8. Both parties shall keep confidential any confidential information which has been or is disclosed to it by the other. Confidential information includes, without limitation, information as to business methods, dealings or plans, not known to the other prior to disclosure, except where such information is already in the public domain (through no fault of the recipient) or where such information is required to be disclosed by any court or regulatory authority.
9. The Purchase Order and these Terms contain the entire agreement and exclude all pre-contractual representations (including any implied at law so far as legally permissible).

Miscellaneous terms.

These Terms may be changed by us at any time. You should regularly check for updates in these Terms as you will be deemed to accept the Terms (as amended) when you next use the Website following any amendment.

Headings are inserted in this Agreement for ease of reference only and do not form part of it for the purposes of interpretation.

Failure by us to exercise or enforce any rights conferred by the Terms or at law shall not be deemed to be a waiver of any such right nor operate so as to bar the exercise or enforcement thereof at any time or times thereafter.

If any provision of this Agreement is determined to be illegal or unenforceable by any court of competent jurisdiction it shall be deemed to have been deleted without affecting the remaining provisions.

mihnati.com reserves the absolute right, without giving any reasons, to decline, cancel or remove any Advertisement or provision of Services for any reason and at any time without prior notice.

For Employers/Advertisers: each Subscription is for a single organization only as included in your registration information. On registration, you will be allocated a user name and password ("ACCOUNT"). You may choose to authorize your employees (together "Users") to use your ACCOUNT whilst carrying out the business of your organization. You are responsible for all use of the Services by all such Users and anyone else using your ACCOUNT and for preventing unauthorized use of your ACCOUNT.

Governing law

These terms and conditions shall be interpreted in accordance with GCC law and all disputes shall be decided by the GCC courts.
